These Terms of Service ("Terms") govern your use of the services provided by Equity Insurance Services ("we," "us," or "our"), located in Honolulu, Hawaii. By contacting us, using our website, or engaging with our automated AI receptionist by phone, you agree to these Terms. Please read them carefully.
1. Services Provided
Equity Insurance Services is an independently owned insurance brokerage based in Honolulu, Hawaii. We are not affiliated with Equity Insurance in Tulsa, Oklahoma, or any other company operating under a similar name. Our services include insurance consulting, quote generation, and policy placement for personal and commercial lines of coverage.
As part of our intake process, we operate an automated AI receptionist that answers inbound calls, collects basic information about your insurance needs, and routes your inquiry to our team. This system is informational and preliminary only — it does not bind coverage, issue policies, or constitute a formal insurance application.
2. SMS and Text Messaging Program
Equity Insurance Services sends transactional text messages to individuals who have opted in during a phone call with our AI receptionist. By verbally confirming your consent during the call, you agree to receive transactional text messages from Equity Insurance Services.

Program description: After speaking with our AI receptionist, callers who request an insurance quote receive a single text message containing a link to complete the appropriate intake form for their policy type on our website (equityinsurance.services/intake). Messages are strictly transactional. We do not send promotional or marketing messages via SMS. Marketing and prospecting communications are conducted via email only, never via SMS.
Message frequency: Typically 1–3 messages per inquiry.
Rates: Message and data rates may apply depending on your carrier and plan.
Opt-out: Reply STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT at any time to unsubscribe. You will receive one final confirmation message and no further texts will be sent.

Re-subscribe: Reply START at any time to resume receiving messages.
Data protection: Your phone number and SMS consent data are never sold, shared, rented, or transferred to any third party for any purpose, including marketing.
Carriers are not liable for any delayed or undelivered messages.
3. Consent and Opt-In
Your consent to receive text messages is collected verbally during your call with our AI receptionist. The receptionist will explicitly inform you that a text message containing an intake form link will be sent to the phone number you have confirmed. You will be asked for your verbal agreement before any message is sent. Your consent is logged with a timestamp via call transcript and is retained for compliance purposes.
Consent to receive SMS messages is not required as a condition of obtaining any insurance product or service from Equity Insurance Services.
4. User Responsibilities
When engaging with our services — including our AI receptionist — you agree to provide accurate and truthful information to the best of your knowledge, use our services only for lawful purposes and in accordance with these Terms, not attempt to interfere with, disrupt, or misuse our automated systems, and notify us promptly if you believe your information has been used without authorization.
5. No Coverage Guarantee
Information gathered through our website or AI receptionist is preliminary and for inquiry purposes only. No coverage is bound, no policy is issued, and no insurance contract is created through these interactions. All coverage is subject to underwriting review, carrier approval, and formal policy issuance. We make no guarantee that any specific coverage will be available or affordable based on information provided.
6. Privacy
Our collection, use, and protection of your personal data — including data collected during phone calls and via SMS — is governed by our Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Equity Insurance Services shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including but not limited to reliance on information provided through our AI receptionist or website. Our total liability for any claim arising from these Terms shall not exceed the amount you have paid us for services in the three months preceding the claim.
8. Governing Law
These Terms are governed by the laws of the State of Hawaii, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Honolulu County, Hawaii.
9. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Continued use of our services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
